The legal dispute over the planned Heumarkt high-rise building by Michael Tojners Wertinvest has one more facet. In its judgment published on Thursday, the European Court of Justice (ECJ) came to the conclusion that the obligation to carry out an environmental impact assessment (EIA) for an urban development project should not depend solely on its size. If an EU state sets thresholds, other aspects such as location must be taken into account.
