“I am not aware of any settlement that just creates in perpetuity a freedom from investigation,” Gilbride noted, adding that she had never seen an organization secure a perpetual shield covering future members. “It’s like they’re selling an insurance policy against EEOC investigations. I’m concerned about the incentive that that creates for employers, especially when the organization is explicitly marketing itself in that way.”

“Normally a settlement happens because the parties don’t want to keep litigating,” Gilbride observed. “But it seems like there might be a lot of alignment between the two sides in this particular situation, and that raises questions about whether the settlement is in the broader public interest or whether it’s just in the interest of these particular individuals and organizations.”

The Structural Shift for Transgender Workers

While the EEOC has historically maintained established processes allowing religious employers to raise specific statutory defenses against discrimination claims—which the agency then investigates and evaluates on a case-by-case basis—this settlement bypasses the investigative phase entirely.

By enforcing a categorical exclusion based solely on group membership, the agency leaves impacted workers with no administrative remedy. Employees who face workplace harassment or termination after coming out as trans or nonbinary are told to independently finance and litigate their claims in federal court.
