Meta has been fined €500 by the ADR Center following an alternative dispute resolution process after its automated moderation systems wrongfully flagged and permanently blocked the Facebook page of Italian outlet Il Giornale di Oristano. Despite the favorable outcome and penalty, the suspension remains unreversed, crippling the publication’s digital operations.
The Algorithmic Misclassification of Investigative Data
The incident stems from a piece published two months prior. Il Giornale di Oristano shared an article analyzing the provincial distribution of escort services across Sardinia. The goal was journalistic: using data to inform and denounce human trafficking and exploitation networks operating in the region.
Meta’s automated filters missed the nuance. Stripping away the context of public interest, the platform’s systems categorized the post as content related to human trafficking and prostitution. Instead of flagging the content for human review, the system executed a takedown.
Director Pietro Serra immediately contested the initial penalty, submitting formal appeals. The algorithmic response was absolute. The appeal was rejected, and the automated system confirmed the permanent block of the account. The page remains visible to readers on Facebook, but the newsroom is locked out of its publishing backend, rendering standard editorial operations impossible.
ADR Center Ruling vs. Platform Immunity
Seeking an external remedy, the publication brought the dispute to the ADR Center, utilizing out-of-court dispute resolution mechanisms designed for online platform governance. The proceeding yielded a favorable outcome for the newsroom, ruling against Meta and issuing a €500 penalty.
Despite the outcome of the procedure and the sanction, the platform failed to restore the publisher’s privileges. The account remains blocked.
“Quanto accaduto ci preoccupa perché un contenuto giornalistico, nato con l’obiettivo di informare e mettere in evidenza un fenomeno delicato come lo sfruttamento legato alla prostituzione, è stato interpretato in maniera completamente opposta rispetto al suo reale significato,” stated the newsroom via its press office, emphasizing the broader systemic threat.
The statement continued: “Ancora più preoccupante è il fatto che, nonostante il ricorso accolto e la sanzione nei confronti di Meta, la situazione non sia stata ancora risolta. Non si tratta soltanto del nostro giornale: casi simili hanno riguardato anche altre realtà editoriali. È necessario garantire maggiore attenzione alle decisioni automatizzate quando incidono concretamente sulla libertà di informazione e sull’attività dei giornali.”
