The latter, after the Second Chamber of the Supreme Court determined in October 2021 that the Minister of the Martial Court was competent.

Within the framework of the investigation and through a letter entered this week, the deputy prosecutor of Aysén, Luis González Aracena, asked the Guarantee Court of Coyhaique to order a hearing.

Specifically, the persecutor’s request was aimed at “propose conditions of conditional suspension of the procedure with respect to all formalized defendants” in the cause.

In addition, it is indicated that on the day of the hearing the grounds and conditions that support the measure will be delivered.

By order of the Coyhaiquino court, the discussion will take place on February 22 at 10:00 a.m.

According to sources consulted by the BioBioChile Investigation Unit, the prosecution will offer the defendants to return the money obtained irregularly in exchange for not continuing the criminal investigation against them for now.

If the deadlines are met, the defendants would pass after a while to be dismissed from the process.

In parallel, the prosecution body in Aysén hopes to formalize nine others involved in the case in mid-March.

Meanwhile, the rest of those involved, all active officials of the military institution, will continue to wait and continue to be investigated by Minister Rutherford.

Consulted by this means, the Aysén Prosecutor’s Office indicated that they would not issue statements until the day of the hearing that will define the future of the case, at least in ordinary justice.
