Federal Judge Vacates Trump Administration Visa Suspension Policy for 75 Countries

A federal judge in New York has vacated a Trump administration policy that suspended the processing of visas from 75 countries. U.S. District Judge Jeannette Vargas, an appointee of former President Joe Biden, ruled that the directive exceeded statutory authority and ran afoul of federal immigration law. The decision halts a policy that had blocked immigrant visa applications from nations whose nationals the administration deemed likely to require public assistance in the United States.

The blocked directive targeted 75 nations, including Afghanistan, Iran, Russia, and Somalia. In her ruling, Judge Vargas set aside the policy as “contrary to law and in excess of statutory authority.” The judge determined that Secretary of State Marco Rubio exceeded his authority by issuing the mandate, noting that the policy “runs afoul” of the Immigration and Nationality Act by requiring “the refusal of visas to eligible applicants without any basis in law.”

Authority Restored to Consular Officers

At the core of the court’s decision is the statutory distribution of authority regarding visa adjudications. Judge Vargas emphasized that federal law places the responsibility of reviewing applicant eligibility squarely on consular officers.

“Congress imbued these officers with exclusive authority and discretion to determine if an immigrant is eligible for a visa based upon review of specific and detailed criteria set forth in the statute,” Vargas wrote, adding that the policy “represents a direct abrogation of this statutory scheme” by categorically prohibiting visa issuance based solely on an applicant’s nationality.

The litigation was initiated by two nonprofit organizations alongside 11 individual plaintiffs. The individual petitioners included six people whose family members had faced visa refusals, as well as five individuals living outside the United States who had filed employment-based petitions to immigrate.

Advocates Praise the Ruling on Family Reunification

Immigration advocates and legal service providers discussed the federal court’s decision. Anna Gallagher, the executive director of CLINIC—one of the organizational plaintiffs—welcomed the ruling.

“We welcome this ruling because, at its heart, this case is about keeping families together,” Gallagher said in a statement, noting that the decision upholds both Catholic social teaching and the rule of law to allow families to pursue reunification.

Diana Konate, deputy executive director for policy and advocacy at African Communities Together, a Harlem-based nonprofit that also joined the lawsuit, called the outcome a victory. “This unlawful and racist ban caused immeasurable harm, cruelly keeping families and loved ones apart,” Konate said. “Today, we are elated to tell our community members: this ban is no more.”

Administration Stance and Public Charge Rules

The suspended policy originated from administration efforts to tighten restrictions surrounding potential immigrants who might become public charges. When the policy was initially enacted, the State Department instructed consular officers to halt immigrant visa applications from the 75 designated countries, citing data from the Council of Economic Advisers indicating that over 30 percent of households with immigrants from those nations utilized some form of public assistance.

In response to the court’s ruling, the State Department stated that the administration remains committed to “protecting the American people by upholding the highest standards of screening and vetting of visa applicants,” while declining to comment on pending litigation.
