According to a class action lawsuit filed Monday in federal court in San Diego, Ferrari allegedly failed to repair vehicles where the brakes could partially or completely fail. “Ferrari was required by law to disclose the brake failure as a known safety defect, but failed to do so,” says the lawsuit, which seeks unspecified damages. The defects were not remedied with recalls due to leaking brake fluid in 2021 and 2022.
Traders are said to have downplayed concerns
The lawsuit is led by Iliya Nechev, a Ferrari owner from San Marcos, California. Nechev explained that he “came close to an accident several times” because of the brake defect. His dealer brushed aside concerns by saying that the brakes were normal and just took some getting used to. Nechev said he would not have bought his 2020 Ferrari if he had known about the problems. The lawsuit states that a master cylinder in the brakes needed to be replaced.
Bosch is also being sued as the supplier of the allegedly defective parts. The company did not immediately respond to a request for comment Tuesday. Ferrari did not address the specific lawsuit, but said safety was its top priority.
