Joaquín Ramírez does not want to lose his large assets and files an appeal

Joaquín Ramírez Gamarra, current mayor of Cajamarca and former secretary general of Fuerza Popular, filed an appeal to annul the judicial decision to confiscate him of 256 real estate.

The appeal appeal questions the legality of the decision of the Fourth National Preparatory Investigation Court. It indicates that “the judge has not motivated the need for the measure of seizure and dispossession of assets.”

And that, in addition, since March 2021 there is a judicial prohibition registered in Public Registries to transfer ownership of assets. “Therefore, a more serious measure is not necessary,” says the document accessed by La República.

“The elements of conviction that support the need for a seizure and that demonstrate an imminent danger that the assets will disappear have not been individualized,” it says in the appeal.

Likewise, it says that the measure was executed when the judicial order had already expired, since the judge gave two weeks – from March 14 – to the prosecutor specialized in money laundering, Wilson Salazar. This, to execute the judicial resolution and proceed to seize the assets or it would expire. José Luis Castillo Alva, lawyer for Ramírez Gamarra, argues that, to avoid expiration, the prosecutor would have requested a clarification, which was resolved, according to him, when the decision had already been finalized.

The appeal will be reviewed by the judge who granted the measure of seizure and dispossession of the assets. “If the document complies with the legal formalities, the file will go up to the National Appeals Chamber to examine the case and make a decision.” If the resolution is upheld, the seizure will continue. Otherwise, the assets return to the domain of Joaquín Ramírez.

Ramírez made millionaire contracts with income from the UAP

During the seizures made of the multiple assets of former Fujimori congressman Joaquín Ramírez Gamarra, copies of the million-dollar contracts he made with his uncle, the former rector and former general manager of the Alas Peruanas University (UAP), Fidel Ramírez Prado, were found.

According to these documents, during the administration of Fidel Ramírez as rector of the UAP, Joaquín Ramírez sold and rented his properties for 30 years. And he also built others to the university through his 11 companies for more than 183 million soles.

The main one of these companies is Lima Engineering & Construction and received S/ 67.7 million. They are followed by Constructora e Inmobiliaria Habitaria, about S/ 38.4 million, and Integral Technologies, S/ 32.6 million. And Capricorn Import, S/ 22.2 million, according to calculations by the Specialized Prosecutor for Asset Laundering.

“The documents prove that Fidel Ramírez kept the university under control. He used the funds of this entity to preferentially hire companies managed by his nephew Joaquín Ramírez ”, specifies a report by La República.

Joaquín Ramírez received 15% of the monthly income of the UAP

With Lima Ingeniería y Construcción, Joaquín Ramírez’s favorite company and which he founded with a capital of S/5,100, he signed “educational cooperation agreements” with Alas Peruanas, obtaining huge profits.

Ramírez Gamarra declared before the National Election Jury (JNE) that he owned the shares of 9 companies for more than S/13.2 million. This, when he ran for mayor of the province of Cajamarca in 2022. All were —and continue to be— under investigation by the Special Prosecutor for Money Laundering. Among them, Lima Engineering and Construction, a “key piece” in the investigation of the former Secretary General of Fuerza Popular.

“Although it was established on February 28, 2003 with a simple capital of 5,100 soles, it became the main contractor of the Alas Peruanas University (UAP). This, during the management of his uncle Fidel Ramírez Prado as rector and general manager of the study center ”, the report specifies.

The “educational cooperation agreements”

Joaquín Ramírez, sold or rented real estate to the UAP. He also built or refurbished university establishments through his companies. But another of the frequent modalities that Fidel Ramírez applied to favor his nephew’s company were the so-called “educational cooperation agreements.”

With these agreements -signed by Fidel Ramírez and Joaquín Ramírez-, the rector and manager of the UAP was able to set up a series of subsidiaries throughout the country, such as in Cajamarca and Tumbes. The “agreement” consisted of Joaquín Ramírez ceding to his uncle Fidel Ramírez a property he owned as an educational infrastructure. In exchange, he gave him 15% of the total gross monthly income that the UAP obtained. And for 30 years.

There is a property located in El Bebedero, Tumbes, owned by Lima Ingeniería y Construcción, which since 2007 was “assigned” to the UAP until 2037. And another in Fundo Vista Alegre, Cajamarca, valid until 2038. According to the Specialized Prosecutor in Money Laundering, Lima Engineering and Construction, between 2003 and 2016 he billed the UAP more than S/67.7 million, during his uncle’s administration.

Some very interesting information, according to Jorge Aspauza Razuri, is that the lawyer who signed the contracts between Joaquín Ramírez Gamarra and his uncle, director of Alas Peruanas, Fidel Ramírez Prado, would be Willy Ramírez Chávarry, the same one who appears as president of the jury that put him “Summa Cum Laude” to the National Prosecutor, Patricia Benavides.
