According to Fulton County Juvenile Court documents obtained by TMZ, the police investigation began after an officer was dispatched to North Fulton Hospital on April 24, 2026. The alleged victim and her father reported that an assault had occurred the previous day. The female classmate told investigators that she was hanging out at a Life Time Fitness facility when she encountered Kroy Biermann Jr., who suggested they visit the co-ed sauna. To reach the sauna, patrons walk through a family changing room, where the alleged incident took place.


According to Page Six, court papers detail that the teenager began making jokes and flirting before entering a changing area and saying, “hey, look at this.” The victim stated that despite repeatedly telling him “no” as he grabbed her body and kissed her, the teenager forced oral sex and digitally penetrated her before she managed to escape. Police reviewed surveillance footage confirming that the younger Biermann was present at the gym on the date in question, although court records note he did not scan into the facility.
Hospital examination records cited in the police reports noted that medical personnel did not find male DNA in the victim’s mouth or vagina following the April 24 examination. Following weeks of investigation and police contact with Kroy Biermann Sr. initiated in mid-May, authorities took the 15-year-old into custody on August 17.
Family Defense, Denials, and Ongoing Legal Turmoil
Kim Zolciak, 48, issued a strong public statement on Friday vigorously defending her son. “The allegations being made against my son are nothing short of reckless and deeply troubling,” Zolciak said in a statement provided to media outlets. “He categorically denies ever being involved with this woman or engaging in the conduct she has alleged.” Zolciak also pointed to the hospital medical examination showing no male DNA and claimed her son voluntarily passed a polygraph test.
Defense representation has echoed those denials. Attorney Jason Sheffield spoke out regarding the charges, stating, according to Page Six: “He is not only presumed innocent, but is in fact, innocent.”
