Kiran faces up to 10 years in jail; Scientific evidence will strengthen the case

Kollam: The plaintiffs estimate that the accused Kiran Kumar (kiran kumar) will be sentenced to a maximum of 10 years imprisonment when the verdict is pronounced today in the vismaya case that has shaken the conscience of Kerala.

Kirankumar, the accused in the Vismaya case, has been charged under various sections of the Indian Penal Code and the Dowry Prohibition Act. Let’s see what it is.

IPC 304b
This section is charged in the case of death following dowry torture. The maximum penalty under this section is imprisonment for a term not less than seven years or life imprisonment

IPC 498A
Department against harassment in the name of dowry. The offense is punishable by up to three years in prison and a fine

IPC 306
Suicide incitement offense. IPC 306 provides for imprisonment for up to 10 years and a fine

IPC 323
This is a section against physical harm. The offense is punishable by up to one year in prison. And a fine may be levied on the accused.

IPC 506
IPC 506 is a provision against intimidation. Defendant faces up to two years in prison and a fine if convicted.

Apart from this, Kiran Kumar has been charged under sections 3,4 of the Dowry Prohibition Act. The offense is punishable by up to two years in prison and a fine.

The prosecution hopes that Kiran will be sentenced to at least 10 years in prison if convicted of all the offenses under the burdensome sections.

Sasthamcotta DySP P. Rajkumar said that the main challenge in the investigation of the Vismaya case was the collection of scientific evidence. P Rajkumar told Asianet News that he hoped the court would accept the evidence gathered by the probe team

Awesome case

The trial of the case began on January 10. The prosecution argued before the court that Vismaya would have been constantly harassed for demanding more dowry. The prosecution also produced WhatsApp messages sent to Vismaya’s mother, friend and Kiran’s sister. For the prosecution, 42 witnesses, 120 documents and 12 bribes, including phones, were produced in court. Defendant, however, contended that phone conversations and messages could not be taken as evidence. Kiran Kumar, a Transport Department official, was sacked after a departmental inquiry.

Relatives say Vismaya’s husband Kiran Kumar will receive exemplary punishment. The cross-examination of witnesses will not affect the case. The daughter suffered mental anguish. Kiran Kumar used to beat his daughter in the name of dowry. Even after marriage, Kiran Kumar demanded a dowry of Rs 10 lakh. Amazingly, he sent pictures of his tortured mother to his mother. Vismaya’s mother says that Kiran Kumar’s sister also knows about the torture
