Know the rules for accessing the shared medical record

A decree published in Official newspaper specifies the rules for access to patients’ Shared Medical File (DMP) documents. These access rights are automatically applicable, unless the holder decides otherwise.

Access to a patient’s DMP is reserved for professionals who actually care for them. Professional members of the patient’s care team are deemed authorized to access the DMP of the patient who has been informed in advance and who has not filed an objection. Professionals who are not members of the patient’s care team must obtain explicit consent from the patient at each consultation of their DMP by any means, including dematerialized.

Professionals can only access the categories of data provided according to their function and must only access, within these categories, the data strictly necessary for the care of the patient.

All accesses and actions on a DMP are traced in the DMP system. These traces can be consulted and used at any time by the holder, who must also be notified, by any means, of any first access by a professional to his DMP.

In total, Nineteen professions or disciplines can access the DMP, including doctors, nurses and pharmacists. Health, social and medico-social professionals exercising coordination functions also have access to the DMP but in a restricted manner (consultation or visit form, liaison letters upon leaving a care establishment or a social or medico-social structure, note of transfer, emergency liaison file, medico-social assessment grid, etc.).

Any access outside of the aforementioned rules is punishable by imprisonment and a fine.
