Democratic Party presidential candidate Lee Jae-myung submitted an answer to the court asking the court to “dismiss the lawsuit” in relation to being sued by the family of the murder case of his nephew, whom he defended in the past. The bereaved family filed a lawsuit alleging that Lee suffered emotional distress over his downplaying of the murder case as ‘date violence’.

According to the legal community on the 21st, Candidate Lee submitted an answer to the Seoul Central District Court’s 28-man Civil Civil Affairs Division (Chief Judge Lee Hyung-sik) on the same day, asking the family of the victim A to dismiss the claim for damages against Lee.

According to lawyer Lee Byung-cheol, a representative of the bereaved family, Lee Byeong-cheol’s side wrote in the answer, “We deny all of the plaintiff’s allegations.” He said, “We are investigating the facts to write a specific answer. As soon as we understand the specific facts, we will submit detailed preparations.

Lee Jae-myung, who called ‘murder crime’ as dating violence

Earlier, on May 8, 2006, Lee’s nephew, Kim Mo, visited Mr. A’s home in Gangdong-gu, Seoul, and wielded a weapon he had prepared in advance to kill Mr. A and his mother. In the process, A’s father jumped off the 5th floor apartment veranda to avoid Kim and was seriously injured.

Candidate Lee, who served as a lawyer for Kim’s first and second trials, became controversial because it was later re-examined in the trial that Kim was mentally and physically weak. After Kim was sentenced to life in prison in both the first and second trials, the appeal was withdrawn, and the verdict was confirmed.

On November 25, last year, candidate Lee said, “A member of my family has committed a felony of dating violence in the past.” In response, the family of Mr. A filed a claim for damages of 100 million won on December 9, last year, saying, “I suffered psychologically from Lee’s remarks.”

Candidate Lee submitted an answer on the 2nd of last month, 51 days after the court served the complaint. According to the Civil Procedure Act, the defendant must file an answer within 30 days of receiving the complaint, and if the submission of the answer is delayed, a judgment without pleading may be issued.

The court in charge of Lee’s case also notified that the sentencing date would be held on March 17 when Lee did not submit an answer. However, as Lee submitted an answer late, the sentencing date is expected to be later than the scheduled date.

In this regard, lawyer Lee said, “Lee is consistent in taking time even though he is well aware of the specific facts. I am not doing it,” he pointed out.
