Legal Battle: OpenAI and Microsoft Accused of Copyright Infringement With ChatGPT AI Model Training

OpenAI and Microsoft were sued Tuesday for misusing the works of nonfiction authors to train the artificial intelligence models that underpin services such as OpenAI’s ChatGPT chatbot.

OpenAI copied tens of thousands of nonfiction books without permission to teach its large language models to respond to human messages, said author and Hollywood Reporter editor Julian Sancton, who is leading the proposal. class action lawsuit filed in Manhattan federal court.

This action is one of several filed by groups of copyright holders, including authors John Grisham, George RR Martin and Jonathan Franzen, against OpenAI and other technology companies for the alleged misuse of their works to train artificial intelligence systems. The companies have denied the allegations.

Mr. Sancton’s complaint is the first copyright lawsuit against OpenAI to also name Microsoft as a defendant. The company has invested billions of dollars in the artificial intelligence startup and integrated OpenAI’s systems into its products.

Representatives for OpenAI and Microsoft did not immediately respond to requests for comment on Tuesday’s lawsuit.

“While OpenAI and Microsoft refuse to pay nonfiction authors, their artificial intelligence platform is worth a fortune,” Justin Nelson, Mr. Sancton’s lawyer, said in a statement. “The basis of OpenAI is nothing other than the rampant theft of copyrighted works.

In his lawsuit, Sancton claims that OpenAI copied nonfiction works, including his book “Madhouse at the End of the Earth: The Belgica’s Journey into the Dark Antarctic Night” to train its GPT language models.

The complaint also states that Microsoft was “deeply involved” in the training and development of the models and is also responsible for copyright infringement.
