Makala Central Prison: The Court of Cassation instructs magistrates to release detainees “without a file”

Magistrates have been instructed to release detainees “without records” at the Kinshasa penitentiary and re-education center, commonly known as Makala central prison.

This instruction was given by the first president of the Court of Cassation, Léon Ndomba Kabeya, during a meeting held Monday March 25, 2024.

“All people in detention without a file and who ended up in prison by chance we will release them. If this type of situation exists, we will ask the prosecution to release them. There are also people with files that have been lying around, taken under advisement with endless postponements. Start checking who has served how long in prison,” said Léon Ndomba.

And to add:

“It is not normal that for a chicken theft case, someone can serve 5 years here, beyond the period that they might serve their sentence if they were already convicted. Check all these situations so that the procedure is accelerated so that those who must be pronounced are notified during the week. What needs to be regularized, we regularize it,”

Faced with this situation, the magistrates present at this meeting were instructed to work hard so that a report on this subject was ready.

In the Council of Ministers last Friday, the Head of State, Félix Tshisekedi, questioned the Minister of State in charge of Justice on the prison situation in Makala.
