Bern: Punished for pulling the emergency brake and breaking a train window

A man, who activated the emergency device of a train before smashing the window with a hammer, has just been sentenced.

A 26-year-old man was recently convicted of property damage and other crimes. This for, among other things, activating the emergency brake on a train going to Rosshäusern (BE), just after it had left a tunnel. He then took an emergency hammer and smashed a side window. After that, he got out of the stationary train through the broken window and fled along the tracks.

His action caused damage of around 2,200 francs. By activating the emergency brake and crossing the track, he knowingly and deliberately abused a safety device and disrupted operations. Later, when the police wanted to check him, he refused to give any information about himself.

Abuses continued

While the railway company does not comment on the matter, spokesperson Stefan Locher explains the procedure to follow when activating the emergency brake: “When the device is activated, the employees on the train act according to a defined process . The train stops at the nearest suitable location and the staff checks what emergency it is before taking appropriate action.” In the event of abuse, offenders are prosecuted.

The 26-year-old man was found guilty by the public prosecutor, among other things, of property damage and violation of the Railway Act. He was sentenced to 70 day fines of 30 francs each (i.e. a total of 2,100 francs), with a two-year reprieve. He must still pay a fine of 600 francs and costs of 800 francs. In addition, he will probably have to compensate the railway company for damages of 2,200 francs in civil proceedings.
