María Elena Swett is in the middle of the trial in New York, in order to achieve the long-awaited reunion with Santiago, her 11-year-old son. After long and painful months of separation, the actress settled in that city and would not return until her offspring was back with her.

On April 6, Mane Swett surprised by publishing a photo that showed his presence in the gringo “big apple.” Days later, a close person would confirm that she went there to face the father of her son, the writer John Bowe, in court.

The interpreter has never directly referred to her drama as a mother. It turns out that Mane goes all out: he has five lawyers working and the allegations established that the boy grew up in Chile, lived with his mother and traveled twice a year to New York to stay with his father. It was an arrangement that was established in custody orders issued in 2013 and 2014, in both countries.

It was indicated that despite this, during the last 14 months the child lived exclusively in the United States with his father, “who, supposedly, in apparent contravention of these orders, refused to allow the child’s return to Chile,” published the aforementioned half.

The child will have his own, independent lawyer

It was on February 23 when Mane, through one of his lawyers, presented a Petition for the Return of a Child before a New York court. That same day, the actress gave a clue in Instagram publishing a series of photos: some with her Kitten, and another with some candles.

The trial is currently continuing: the father is working with four lawyers, Chilean witnesses who knew Santiago have been presented and the judge has been asked to reserve the child’s personal data, in addition to other family aspects.

An important determination of the court was to appoint a lawyer to represent the interests of the child himself, independent of the positions of his parents. That task was left to Professor Jennifer Baum, director of a child defense clinic who has already played the same role in other trials.

One of the lawyer’s first concerns was to ask the court to protect the confidentiality of the testimony that the minor would give, in order to protect his “health and safety.”
