Mexico City Driver Charged in Deadly Dragging of Motorcyclist

Mexico City – A judge has formally charged Gaby ‘N’ with homicide following the death of a motorcyclist she allegedly struck and dragged for nearly two kilometers in the Iztapalapa borough on January 3rd. The charges include the aggravating factor of “saña,” or cruelty, due to the manner in which the incident unfolded, according to legal representatives of the victim’s family.

The case has drawn significant attention in Mexico City, sparking outrage and calls for justice. Authorities allege that Gaby ‘N’ continued driving after hitting Roberto ‘N.’, dragging his body along the roadway. The incident prompted a widespread search for the suspect, who was apprehended weeks later in Oaxaca.

Ricardo Díaz Estrada, part of the legal team representing the victim’s family, explained that the “saña” qualifier was applied because the driver continued on her way after the collision. “The way the event occurred determined that it was done with saña,” Díaz Estrada stated, as reported by La Jornada. This legal designation signifies a particularly egregious form of intent and can lead to a harsher sentence.

The judge has granted authorities two months to complete their investigation, with a deadline of April 17th. Gaby ‘N’ will remain in pre-trial detention at the Santa Martha Acatitla women’s prison, pending further legal proceedings. The potential sentence, if convicted, could range from 20 to 50 years in prison, according to reports from Heraldo de México.

During the hearing, which lasted over two and a half hours, Gaby ‘N’ reportedly remained silent, invoking her right not to provide a statement. Her defense team attempted to challenge the evidence presented by the prosecution, but the judge deemed it sufficient to proceed with the criminal case, as detailed by MVS Noticias.

The victim, 52 years old, was riding a motorcycle when he was struck by Gaby ‘N.’s vehicle at the intersection of Eje 6 Sur and Periférico Oriente in Iztapalapa. She was arrested last week in Oaxaca, according to multiple reports.

Gaby ‘N’ has reportedly lost her job as a nurse at Hospital Juárez due to her prolonged absence, MVS Noticias reported. The investigation will now focus on gathering further evidence and preparing for a potential trial.

The case continues to unfold as authorities gather evidence and prepare for the next phase of legal proceedings. The outcome of the investigation and subsequent trial will be closely watched by the public and legal observers alike.
