Federal prosecutors in Mexico have formally rejected opening an investigation into Andrés Manuel López Beltrán—widely known as “Andy”—after his moniker surfaced in witness testimonies tied to a smuggling ring, commonly referred to as fiscal huachicol. Despite statements from naval officers pointing toward political friction and high-level accommodations, the Fiscalía General de la República (FGR) maintained that no credible data of legal weight exists to substantiate a formal inquiry against the son of former President Andrés Manuel López Obrador.

The Witness Testimonies: How ‘Andy’ Entered the Customs Inquiry

The controversy stems from an ongoing probe cataloged under file FED/FEMDO/FEIORPIFAMF-CDMX/0000568/2024. Within these legal documents, investigators logged statements from two naval officers who held management or sub-management positions within Mexican customs. Neither testimony directly accuses Andrés Manuel López Beltrán of committing a crime, but both place him at the center of whispered political negotiations involving illicit hydrocarbon trafficking.

The first account comes from Captain Alejandro Torres Joaquín, the former director of the Customs Office in Tampico who later secured protected witness status under the code name “Santo.” In a written statement delivered on May 13, 2025, Torres detailed his contacts following the seizure of the vessel Challenge Procyon on March 19, 2024, which carried 10 million liters of illegal fuel in Tampico. Torres stated that he reached out to Miguel Ángel Solano Ruiz—known as “El Capitán Sol” and alleged to be the liaison for the Farías brothers in customs operations—to warn him that operational staff were panicked. According to Torres, Solano replied that the situation involved “political clashes between Security Secretary Omar García Harfuch and the President’s son, but that they had already reached an agreement,” instructing him to tell Captain Estudillo that nothing would happen.

A corroborating narrative emerged from Juan Carlos Soto Picha, former subdirector of Customs Operation in Guaymas. Testifying before the FGR on February 27, Soto described an incident in March 2025 when customs allowed the unloading of contraband fuel from the ship Torm Agnes in Sonora. When resistance arose against authorizing the discharge, Soto contacted Solano, who allegedly responded that he would speak directly with Navy Secretary Rafael Ojeda. Soto testified that Solano messaged him saying they would call the Navy Secretary to frame it as an “Andy issue” to see if anyone would dare object, adding that the message was meant “only for your eyes.” Soto added that a colleague named Cordero later assured him the matter had been settled at the Secretariat of the Navy in Mexico City, allowing tanker trucks to clear the area just before fiscal agents arrived.

The FGR Response and Institutional Denials

Faced with mounting media attention regarding these judicial files, the FGR—led by Ernestina Godoy—flatly rejected the premise that an investigation is underway against the former ruling party official. Utilizing official communications channels, the agency took to social media to denounce the reports as entirely fabricated.

“The Federal Public Ministry does not possess any evidentiary data with the necessary legal force to initiate an inquiry in this regard,” the FGR stated via its official X account, addressing the rumors linking the former Morena organization secretary to hydrocarbon smuggling networks.

While investigators continue to untangle how ships laden with millions of liters of unverified fuel bypassed port security, federal authorities insist that casual mentions in witness statements do not meet the strict evidentiary thresholds required under Mexican criminal procedure to launch a formal probe against López Beltrán.
