Million-Dollar Fine Imposed on Win Sports for Streaming Failures in Colombian Soccer Broadcasts

The The Superintendency of Industry and Commerce (SIC) imposed a million-dollar fine on the channel Win Sports, due to failures in its streaming service during Colombian soccer broadcasts.

The sanction stems from an administrative procedure that investigates consumer complaints and the evidence presented by the company.

As a result of this, the entity decided to file a sanction of TWO HUNDRED EIGHTY-FOUR MILLION TWO HUNDRED THOUSAND PESOS M/CTE ($284,200,000). It must be clarified that the sports channel has the right to appeal or appeal.

Statement from the SIC on the sanction of Win Sports

“Bogotá DC, August 31, 2023. The Superintendency of Industry and Commerce, as the Consumer Protection Authority, imposed a million-dollar penalty against WIN SPORTS SAS for an amount of TWO HUNDRED EIGHTY-FOUR MILLION TWO HUNDRED THOUSAND PESOS M/CTE ($284,200 .000), and also ordered it to inform consumers, within its terms and conditions, what are the circumstances that can generate intermittencies or latencies in the service, as well as include a risk management procedure in order to identify and evaluate the possible failures and implement mechanisms to avoid them.

The decision was adopted after carrying out the administrative sanction procedure in which, after analyzing the consumer claims and the other evidence provided by the investigated company, it was determined that there were multiple failures in the service provided through its streaming platform. WIN SPORTS ONLINE, which prevented users from entering the transmissions of sporting events or which caused them, despite having entered, to be faced with latencies or intermittencies.

In this regard, the Superintendency was able to show that the failures in the service occurred in a context of additional vulnerability of consumers to the extent that the social impact derived from the effects of the spread of the COVID-19 virus prevented them from accessing to the date of the events to sporting events in person and led them to consume content via streaming which, in the case of football matches, were only provided through WIN SPORTS ONLINE, as this was the only platform with the rights of transmission and diffusion granted by the Major Division of Colombian Soccer DIMAYOR.

Against the sanctioning administrative act, an appeal for reconsideration is made before the Directorate of Consumer Protection Investigations and/or the right of appeal before the Delegation for Consumer Protection”.
