New Asbestos-Related Cancers Recognized as Occupational Diseases: Find Out Which Cancers are Affected

Finally, good news for asbestos sufferers and the National Federation of Life Accident Victims (FNATH). Cancers of the larynx and ovary caused by the inhalation of asbestos dust are now recognized as occupational diseases.

Which cancers are affected?

The decree published on August 11 and published in the “Official Journal” of August 13specifies which cancers are concerned:

primary laryngeal cancers, primary high-grade laryngeal dysplasia, primary ovarian cancers in the ovaries, tubal serosa, peritoneal serosa.

The creation of this new table of occupational diseases linked to asbestos will enable victims or their families to benefit from better care and compensation.

The National Federation of Life Injuries (FNATH), is delighted with this new entry in the table of occupational diseases.

In what trades?

The decree also specifies for which work:

insulation with materials containing asbestos, their installation, removal, machining, cutting, sanding, handling, asbestos removal work or maintenance of asbestos equipment, or even carried out in premises exposed to asbestos, or requiring the wearing of clothing containing asbestos.

The reimbursement period (maximum time elapsed since the end of exposure) is 40 years, subject to a minimum exposure period of 5 years.

Towards more recognition in occupational diseases

With this new decree, patients should be better recognized and taken care of. Only 130 applications for recognition of laryngeal cancer as an occupational disease were examined between 2010 and 2020, and 6 for ovarian cancer, according to data from Health Insurance.

Despite the ban on its use in France since 1997, asbestos is now the second cause of occupational diseases and the first cause of work-related death (excluding accidents at work).

Until now, only two cancers linked to the inhalation of asbestos were recognized: primary bronchopulmonary cancer and primary malignant mesothelioma of the pleura, peritoneum, pericardium. It is therefore a breakthrough for all those patients who suffer from cancer of the larynx and ovary.
