New criminal case against Navalny – judgment also in Strasbourg

Another criminal case by the Russian judiciary against the imprisoned Kremlin opponent Alexei Navalny begins this Tuesday. This time it’s about allegations of extremism. According to Navalny’s lawyer, the Moscow City Court is sitting in a penal camp 260 kilometers north-east of the capital, closed to the public. President Vladimir Putin’s most prominent opponent faces another 30 years in prison.

Navalny is already serving a nine-year sentence. The 47-year-old has already served more than two years. In all, the judiciary formulated seven new charges, including founding and financing an extremist organization and downplaying Nazism. The opposition denies the allegations.

Navalny was poisoned with the nerve agent Novichok during a trip to Siberia in the summer of 2020. The Kremlin opponent accuses the Russian domestic secret service FSB of being behind the poisoning. After treatment in Germany, he returned to Russia despite the impending prison sentence.

The European Court of Human Rights (ECtHR) in Strasbourg, in turn, will decide on a complaint by Navalny in Strasbourg on Tuesday. He complains that the Russian authorities have not launched an investigation into the poisoning. This violates his right to life and an effective remedy. Russia no longer recognizes the judgments of the Court of Human Rights.

The country was expelled from the Council of Europe because of the war of aggression against Ukraine. It is therefore no longer a member of the European Convention on Human Rights, which the Court of Justice ensures is observed. In Strasbourg, however, several thousand lawsuits against Russia are still pending. The Council of Europe, the Convention on Human Rights and the Court of Justice are independent of the EU.
