OGH decides on May 31 in the case of the killed 13-year-olds

In seven weeks, the Supreme Court (OGH) will deal with the pending appeals in the case of the dead 13-year-old whose body was found lifeless by passers-by on June 26, 2021 on a green strip in Vienna-Donaustadt. This was confirmed by OGH media spokesman Frederick Lendl on Wednesday at the request of the APA. A five-member Senate will therefore meet in a public court day.

Three men of Afghan descent took the girl, who lives in Lower Austria, into an apartment, gave the schoolgirl ecstasy and abused her when the drugs started to take effect. According to the findings of the Vienna Regional Court that are not legally binding, the 13-year-old died a violent death as a result of drug poisoning and suffocation. The three men were convicted on December 2, 2022 in the first instance as charged. The 24-year-old main defendant received a life sentence for murder and rape. A co-accused 19-year-old, who owned the apartment, received 20 years for murder by omission and rape, a 20-year-old for the same crime constellation 19 years.

The 24-year-old, on the other hand, filed a nullity complaint and appeal, the 20-year-old a criminal appeal. In relation to the two men and the scope of their appeals, the decisions of the first instance are therefore not yet final. The 19-year-old, on the other hand, had accepted the judgment of the regional court.
