OGH verdict: Trees are to be expected in the forest

2023-06-01 17:07:00

Living in a castle complex in the middle of the forest – this form of living is not a dream for everyone, but the plaintiff liked it: she has been the owner of a medieval castle complex since 2014. The plaintiff’s plots of land, on which the castle stands, are surrounded by the defendant’s plots of land: trees have been growing on these for decades, and since the 1980s they have also been growing right up to the castle complex. The trees are mostly 30 meters or higher.
