Ojol drivers are pessimistic about getting THR this year – 2024-03-20 16:41:16

The general chairman of the Indonesian Guard Online Motorbike Taxi Driver Association, Igun Wicaksono, admitted that he was pessimistic that this year the online motorbike taxi (ojol) application company would provide religious holiday allowances (THR) for 2024 to ojol drivers. This is because the existence of ojol does not have legality as a public motorized vehicle because it does not have a legal umbrella.

“It’s possible that we won’t get THR this Eid. Until now, ojol has no legality. There is no law that regulates the existence of ojol,” said Igun when contacted by Media Indonesia, Wednesday (20/3).

He said that the problem with the status of ojol was the reason why ojol application companies did not give THR to drivers. Igun stated that until now motorbike taxi drivers have not been appointed as permanent employees and have survived with a partnership pattern.

“Because of its illegal status, application companies can arbitrarily not provide THR because they have no obligation to do so,” stressed Igun.

He explained that every time during Eid, motorbike taxi drivers only get incentives from the company providing the service. However, this incentive is considered not commensurate with providing THR.

“The incentive is not giving cash. However, we are asked to look for orders on the day of Eid. Later there will be incentives given. Not THR,” he said.

He hopes that ojol application companies can comply with the advice from the Ministry of Manpower (Kemenaker) regarding giving THR. The Ministry of Manpower has released a Circular Letter from the Minister of Manpower of the Republic of Indonesia Number M/2/HK.04/III/2024 concerning the Implementation of Providing Religious Holiday Allowances in 2024 for Workers/Labourers in Companies. This is a reference for religious THR payments this year.

The obligation to pay THR by employers to work recipients has been stipulated in Government Regulation 36/2021 concerning Wages.

“There should be a moral burden for companies to pay THR. Motorbike taxi drivers already provide profits to the company. The THR period which is given once a year must involve government intervention,” concluded Igun.

Reject THR Replacement Incentives

Chair of the Indonesian Transport Workers Union (SPAI) Lily Pujiati rejected the company’s provision of incentives to replace THR. So far, members have only received Eid incentives.

“We reject the applicator’s rules for providing Eid incentives. This is clearly not THR,” he said in an official statement.

He said that the granting of THR is based on the status of drivers who are included in the category of fixed-term workers, PKWT (Specified Time Work Agreement) as stated by the Director General of Industrial Relations Development (PHI) and Social Security (Jamsos) of the Ministry of Manpower, Indah Anggoro Putri on March 18 2024.

This THR, Lily continued, must also be paid in full, not in installments, and given no later than 7 days before Eid al-Fitr. He also urged Indonesian public transportation companies to give drivers the right to get days off to gather with family and relatives on religious holidays.

Confirmed separately, Grab Indonesia Chief of Public Affairs Tirza Reinata Munusamy said that his party would provide incentives to ojol drivers.

It confirmed that Grab Indonesia will provide THR to employees who have a conventional work relationship in the form of Fixed Time Work Agreements (PKWT) and Non-Fixed Time Work Agreements (PKWTT).

“Grab provides special incentives for Eid al-Fitr which will be given to partners on the first and second days of Eid,” said Tirza.

This step, he said, is in accordance with advice from the Ministry of Manpower that the form, amount and mechanism of THR can be given in various forms and adjusted by each applicator.
