On July 8, 2022, a bill aimed at making operators responsible for the deployment of optical fiber accountable was tabled. This is examined in public session in the Senate this Tuesday, May 2, 2023.

What is the problem ?

Let us recall the context. The France Very High Speed ​​Plan, launched in 2013 by the government, provided that “all French people could benefit from very high speed Internet access (a speed greater than 30 Mbit/s) by the end of 2022 “, remember the bill.

According to the Senate, this plan made it possible to over 80% of French people connectable to optical fiber in 2022.

However, this with est terni for several years “by problems arising in the realization of the final connection of subscribers which affect the quality of this new network”, can we read in Note of the Senate.

Work for the deployment of fiber will begin on Tuesday February 7, 2023 in the municipalities of Petit-Mars, Joué-sur-Erdre and Casson (Loire-Atlantique).

In detail, these concerns concern the last part of the connection of users. In most cases, this operation is entrusted to Internet service providers who themselves often use a subcontracting chain.

“Recurrent malfunctions” are particularly observed in Essonne, reports the bill.

What would this law change?

The proposed law would therefore aim to “clarify the chain of responsibilities” by providing a better framework for operations in the field.

Article 1 proposes to regulate the training of splicers. All persons working on the networks must validate “a certification required to ensure their skills. No details are given on the contours of this certification.

The proposed law aims to “limit” subcontracting, held primarily responsible for the malfunctions observed.

It should be remembered that currently, there can be up to eight levels of subcontracting; a situation which makes it impossible to identify the party involved and contributes to the diffuse regime of liability observed.

Article 2 proposes to add ” indicators on the quality of the networks” with the aim of refining the Arcep data, and thus, to better understand “the quality of coverage” of the Internet in France.

The text also directly concerns users. Indeed, it intends to better protect you in the event of “prolonged interruption of Internet access service”. A right to suspension of subscription paymentcompensation and termination without charge of the subscription, could be created if the law is adopted.
