According to a report by The Paper, on August 12, 2020, Fang Huahua sneezed on the face of a person surnamed Zhao when he sneezed in the detention center. A quarrel broke out between the two sides. Zhao Nan kicked him in the waist while he was carrying water from a basin. As a result, his head hit the wall directly, and then he fell to the ground and was rushed to the hospital for first aid.
Afterwards, Zhao Nan was sentenced to 6 years in prison for the crime of intentional injury. Fang Huahua was treated in hospitals in Shaanxi, Beijing and other places. I can’t see my eyes, and I don’t feel anything below the neck. After half a year of treatment, my eyesight gradually recovered, and I was transferred to another hospital for surgery, and my ability to walk gradually recovered. It’s just that the good times don’t last long. From June 2022, my body will regress again, and I can no longer get out of bed and walk.
Fang Huahua’s medical expenses have accumulated more than 2 million yuan. Because of the huge amount in arrears, the hospital stopped taking medicines, so that he did not receive follow-up treatment, and his physical condition deteriorated as a result. At the same time, the trial of his case accused of deforestation ended, and he was finally sentenced to 3 years and 2 months. Due to his physical disability and treatment needs, he was allowed to be released on parole for medical treatment and community treatment until the expiration of February this year.
However, due to the delay in receiving treatment, Fang Huahua’s health deteriorated severely. Not only were his feet numb and stiff, but his shoulders and arms also ached. “Hair hurts even if you touch it.” Who should bear the cost of treatment? Li Youde, a lawyer from Hunan Jianzheng Law Firm, believes that Zhao Nan, who committed intentional injury, should bear civil liability for compensation. If he fails to make compensation, the detention center may bear supplementary responsibility.
