According to the legal community, the 50th Civil Agreement of the Seoul Central District Court (Chief Judge Song Kyung-geun) rejected Park’s application for ‘cancellation of the injunction against appearing in broadcasting and entertainment activities’ on the 27th.

The entertainment agency Yespera (now Have Fun Together), entrusted with Park’s management, filed an injunction with the court in August last year, claiming that Park violated her exclusive contract and promoted activities with a third party.

The court accepted Yespera’s application and ordered, “Until the verdict on the original case is finalized, Park Yoochun must not produce, promote, publicize, characterize, appear in, or engage in entertainment activities for third parties other than Yespera.”

Afterwards, instead of filing a new lawsuit, Yespera added a request to ban broadcast appearances and entertainment activities to the lawsuit for damages that was in progress against Park in the same court.

In response, Park’s side said that this method was not legal and that Yespera did not comply with the court’s order to file a lawsuit on the merits within the time limit, so he applied to the court to cancel the injunction decision.

However, the court interpreted, “The basis of the claim for damages due to Park’s breach of exclusive contract and the request for ban on broadcast appearances and entertainment activities is the same.” The change in the purpose of Yespera’s claim is that it can be seen as filing a lawsuit on the merits of the injunction decision.

The court added, “There is no reason to consider that the change of claim is illegal or constitutes an abuse of rights.”

Park was arrested in 2019 on charges of using methamphetamine and was sentenced to 10 months in prison and 2 years of probation. He held a press conference before being charged with announcing his retirement from the entertainment industry, but overturned this and returned to broadcasting after a year.

He was scheduled to return to the screen after five years with the movie ‘Dedicated to Evil’, which will be released next month, but it seems that the decision of the court today will put the brakes on it.
