Pharmacists’ Authority to Administer COVID-19 Vaccine Confirmed by Constitutional Court: Implications for Healthcare Professionals

The Constitutional Court on Thursday confirmed the 2022 law which authorizes pharmacists, under certain conditions, to prescribe and administer the vaccine against covid-19. She thus rejected an appeal from ABSyM, the association of medical unions.

According to the Court, there is no significant reduction in the right to health protection guaranteed by the Constitution, contrary to what the doctors’ association asserts.

Among other things, the Court emphasizes that pharmacists are only authorized to vaccinate against covid-19 on the condition of having successfully completed specific training. In addition, pharmacists manage medications and their missions require expertise in this area, observed the Court in a press release.

Concerning the complaint linked to confidentiality, the high court notes that pharmacies must have a space allowing a confidential conversation with the patient. The confidentiality of vaccination is therefore guaranteed, according to her. The principle of equality and non-discrimination and the right to respect for private life are also not violated.

This judgment also reinforces the law adopted last October authorizing pharmacists to administer the flu vaccine, to the satisfaction of the Belgian Pharmaceutical Association (APB).
