For 38-year-old Xavier and his 35-year-old partner Barbara, the journey was meant to evoke cherished memories. The couple, who met on a beach in Nice sixteen months prior, were deeply in love. Seeking to recreate the magic of their very first weekend together, Xavier booked a surprise flight to Barcelonnette via Wingly, the aviation equivalent of BlaBlaCar.
They boarded the Socata TB21 registered as n229GC alongside Pierre-Yves M., a 50-something engineer from Nice with 637 hours of flight experience, including 140 hours on the Socata model. Pierre-Yves invited his 41-year-old companion, Meriem Brahimi, to sit beside him in the cockpit. Meriem would ultimately be the sole fatality of the crash, while the young couple in the back sustained burns covering 55 percent of their bodies. Lawyer Nicolas Gemsa bluntly characterized the tragedy to the court: “It is a Christmas gift that turns into a horror movie.”
An Ill-Prepared Descent on a Notorious Mountain Runway
The flight departed Cannes-Mandelieu airport at 10:18 a.m., crossing the Col d’Allos before initiating its descent toward Barcelonnette. The destination boasts a 720-meter runway renowned for its technical difficulty. While the pilot had previously landed at the airfield, he had never done so while acting as pilot in command. That first attempt ended in catastrophe.
A witness filming the approach captured the aircraft rushing toward the tarmac at excessive speed. The Bureau d’Enquête et d’Analyses (BEA) later confirmed that the Socata touched down at 110 knots—roughly 200 kilometers per hour—significantly faster than the recommended 73 knots. Tribunal president Sarah Meziani-Gimenez summarized the official findings as “too fast, too steep, too heavy.” Pierre-Yves conceded in court, “Indeed, I started a bit high. I landed a bit further than I thought.” By the time the wheels made initial contact with the asphalt, a full third of the short runway had already passed underneath.
Post-Crash Conflict and Legal Accountability
Approaching the midpoint of the runway and spotting a snowbank ahead, the pilot attempted a go-around maneuver. However, the landing gear clipped the snow, causing the aircraft to veer sideways, strike a tree, and instantly erupt in flames. Meriem Brahimi suffered a fatal cranial trauma upon impact.
The conduct of the pilot following the crash quickly became a major point of contention in the courtroom. Pierre-Yves stated that he lost consciousness and woke up alone, crawling on all fours in the snow to extinguish his burning clothes. Surviving passengers fiercely disputed this account. Xavier Marovelli testified, “He left us to burn alive, and he left his companion to burn in the plane.” Me Gemsa echoed the sentiment, asserting that the pilot “saved his skin and left his passengers to burn.”
Beyond his post-crash reaction, the pilot faced serious questions regarding his pre-flight calculations. Investigators highlighted that he never asked his passengers for their weights to compute proper takeoff and landing mass. Prosecutor Antoine Pesme of Digne criticized the operation as “a poorly prepared and poorly executed landing (…) The speed was not compliant, the slope was not compliant, and the mass was, at best, unverified.” Consequently, the prosecution requested a five-year prison sentence, including four years suspended. Defense attorneys Solal Fitoussi and Patrick De La Grange pushed back against the penalties, calling the demands extremely severe based on a flawed investigative dossier, and entered a plea for acquittal.
