Police Search Warrant Reveals Disturbing Details in Case of Nonbinary Student who Died after High School Bathroom Fight

OKLAHOMA CITY — A police search warrant has recently provided more details in the case of Nex Benedict, a nonbinary Oklahoma student who tragically passed away one day after a high school bathroom fight. It is believed that bullying over gender identity may have prompted the altercation.

According to the warrant filed in Tulsa County District Court, when Nex Benedict’s mother, Sue, called 911 on February 8, she found her 16-year-old child in critical condition. Nex’s eyes had rolled back into their head, their hands were curled, and they were struggling to breathe. Paramedics arrived at the family’s home in Owasso and administered CPR before rushing them to the hospital. Unfortunately, Nex passed away later that day.

Following the fight on February 7, Nex was able to walk out of the bathroom but was later taken to the hospital. Sue Benedict stated that the school nurse had advised her to have Nex checked out after they complained of a headache from hitting their head on the bathroom floor, according to the warrant.

At the hospital, Sue Benedict requested to speak with the police but did not want to file charges at the time. Instead, she asked the police to address the issues among students on campus by speaking to school officials. Nex later shared with The Independent that they had suffered bruises all over their face and eyes in the fight, which involved a transgender student and three older girls. The school district has stated that the fight lasted less than two minutes before it was broken up by other students and a staff member. However, the cause of the altercation remains unknown.

The family, represented by a lawyer, declined to comment on the search warrant. They have initiated their own independent investigation into the incident. A vigil for Nex is planned for Sunday in Owasso.

The search warrant, signed the day after Nex’s death, revealed that investigators took 137 pictures at the school, including inside the girls’ bathroom where the fight occurred. They also collected two swabs of stains from the bathroom and obtained records and documents of the students involved in the altercation. Although the warrant initially suggested that police were seeking evidence in a felony murder, the department has since stated that Nex’s death was not a result of injuries sustained in the fight, based on the preliminary results of the autopsy. The police department has refrained from further commenting on the cause of death until the toxicology and additional autopsy results are completed.

Meanwhile, Owasso school officials have expressed their cooperation with the ongoing police investigation. The school requested the court order to search the premises due to state and federal privacy laws regarding the release of confidential student records.

Tulsa County District Attorney Stephen Kunzweiler, whose office is not currently involved in the police investigation, addressed the tragic incident, urging people not to be swayed by misinformed perceptions fueled by emotional sentiments. He emphasized the importance of allowing law enforcement to conduct their investigation.

The implications of this case are staggering. It highlights the urgent need to address rampant cases of bullying and discrimination faced by nonbinary and transgender individuals in educational settings. Bullying has long-lasting emotional and psychological effects on victims, and in extreme cases like this, it can even result in tragic loss of life. It is crucial for schools to actively promote inclusivity, educate students on the importance of embracing diversity, and take swift action to address incidents of bullying.

This case also underscores the significance of proper investigation and accountability. The collection of evidence and thorough examination of the circumstances surrounding Nex’s death are paramount to ensure justice is served. It is essential that law enforcement agencies handle such cases carefully, ensuring that all angles are explored and no stone is left unturned in their pursuit of the truth.

Moving forward, it is imperative for society to continue pushing for gender equality, acceptance, and understanding. Educational institutions should prioritize comprehensive anti-bullying policies, provide resources and support for LGBTQ+ students, and create safe spaces where everyone feels valued and respected.

In conclusion, the tragic death of Nex Benedict serves as a stark reminder of the challenges faced by nonbinary and transgender individuals in our society. It is a call to action for improved policies, increased awareness, and a commitment to fostering a more inclusive and accepting environment for all. Only through collective efforts can we hope to prevent future tragedies and create a better future for the LGBTQ+ community.
