ALGIERS – The Minister of Labour, Employment and Social Security, Fayçal Bentaleb presented Monday before the specialized commission of the Council of the Nation the text of the law relating to the prevention and settlement of collective labor disputes and the exercise of the right to strike, a text which reinforces the mechanisms of social dialogue as a tool for the adoption of common and consensual solutions contributing to the improvement of professional relations.
During the presentation of the text, which took place in the presence of the Minister for Relations with Parliament, Basma Azouar, the Minister specified that the text of the law “reinforces the mechanisms of social dialogue between the social partners as a tool for the adoption of common and consensual solutions contributing to improving professional relations and establishing socio-economic stability in order to prevent collective labor disputes”.
He recalled, in the same context, that the text of the law was intended to strengthen the mechanisms of social dialogue so that “the use of strikes becomes the solution of last resort and is carried out in compliance with legal procedures in form and substance, i.e. after all avenues of amicable settlement have been exhausted, through dialogue, consultation, collective negotiations as well as mechanisms for reconciliation, mediation and arbitration”.
“The text has consecrated social dialogue as a civilized and peaceful means before and after the collective conflict at work and during the strike”, continued the Minister, adding that “the dialogue will make it possible to overcome conflicts and bring closer views between the parties to the collective conflict through the management of socio-professional concerns and working conditions”.
This law intervenes within the framework of the “directives of the President of the Republic relating in particular to the integration of the definition of the strike in work, as well as its conditions and its legal framework to avoid non-professional and illegal strikes”, has explained the minister.
At the end of the presentation, the members of the commission expressed their concerns with regard to this text of law, highlighting its importance because, they affirm, “it intervenes within the framework of the policy whose the contours were defined by the President of the Republic, Mr. Abdelmadjid Tebboune aiming to carry out profound social reforms, in particular those relating to labor relations and social dialogue”.
