The Investigating Court number 1 of Balaguer ordered the entry into provisional prison for the couple detained in Artesa de Segre this week for the death of their three-month-old son. The case is open for the crimes of homicide or murder, and must be specified throughout the investigation with the evidence provided. The detainees, the 32-year-old father and the 19-year-old mother, both of Brazilian nationality, declared in court that when they woke up last Monday around seven in the morning they saw that the baby was dead. They notified an ambulance from the Medical Emergency System (SEM) and the toilets could only certify his death due to cardiorespiratory arrest. They also notified the Mossos d’Esquadra, who arrested the couple the next day once they found evidence of criminality in the autopsy. In this sense, the forensic report highlights that the suspects could have caused the death of the baby and not a sudden death. In this place, the minor could have died from the “shaken baby syndrome” which is the brain injury suffered by an infant when he is moved roughly and can cause death. According to studies, just five seconds of intense shaking can cause irreparable damage to the child and even death. For this reason, the Prosecutor’s Office requested provisional detention without bail for the couple, arguing that they could have committed a crime, as highlighted in the preliminary medical report, as well as the possible risk of flight since the couple is of Brazilian origin. After listening to their statement and examining the reports, the judge ordered the parents to be placed in provisional prison since they face long prison sentences if they are considered responsible for the crime.
