Proceedings in the Twitter and Elon Musk lawsuit postponed, with the parties given three weeks to complete the acquisition

The judge in charge of considering the lawsuit between Twitter and Elon Musk on Thursday postponed the judicial procedures, giving the two parties until October 28 to finalize the details of the Tesla CEO’s acquisition of the social network, otherwise the trial originally scheduled for the middle of this month will be postponed to November.

And the billionaire’s lawyers requested a few hours ago, to suspend the lawsuit filed by Twitter with the aim of forcing Musk to complete the purchase deal.

They expressed their expectation that the deal would be completed in the “period around October 28”.

In April, Elon Musk offered to the Twitter board of directors to buy the platform for $ 44 billion, before retracting his offer a few weeks later.

And in a new development recorded in the case, Musk offered Monday to move forward with the acquisition at the original agreed price once he received the necessary funds and after Twitter withdrew its lawsuit against him.

After months during which the eccentric businessman attacked the platform and changed his mind several times, the company wanted clear and fast proof that he was serious about the deal.

On Thursday, Twitter’s lawyers objected to Musk’s adjournment of the trial, describing the proposal as aimed at further deception and delay.

And Judge Kathleen McCormick finally issued her decision to “suspend judicial procedures until five o’clock in the evening of October 28, 2022, to allow the parties to complete the deal.”

“If the deal is not completed (by this date), the parties will have to contact me (the judge) by email to get dates for the trial, which will take place in November,” the decision continued.

This judge’s move surprised many observers, because it seemed that the tide was tilting in favor of Twitter. The law of Delaware, where trials of similar cases usually take place, encourage respect for contracts and deals.
