Proposal to expand the recipients of rice land use rights transfer

(PLO)- According to the draft Land Law (amended), there will be no restriction on organizations, households and individuals not directly engaged in agricultural production receiving the transfer of land use rights for rice cultivation.

The Government is organizing to collect people’s opinions on the draft Land Law (amended).

One of the key issues that need to be consulted mentioned in Resolution 170 of the Government is the expansion of recipients of land use rights for rice cultivation.

Specifically, the 2013 Land Law stipulates that households and individuals not directly engaged in agricultural production and economic organizations are not allowed to transfer rice land to implement agricultural production projects. restricting investment in agricultural production, not encouraging the development of agricultural production, mobilizing investment resources in the agricultural sector suitable to concentrated and large-scale commodity agricultural production.

Therefore, the draft Law has been amended in the direction of not restricting organizations, households and individuals not directly engaged in agricultural production to receive the transfer of land use rights for rice cultivation. Clause 4, Article 49 of the draft stipulates that economic organizations that receive rice land transfer must have an agricultural land use plan approved by the People’s Committee of the province.

However, there are also suggestions that it is necessary to limit the recipients of this rice land use right because if it is expanded, it may affect the assurance of productive land for farmers.

Therefore, the Government asked people to give their opinions on the recipients of the transfer of land use rights for rice cultivation.

Also in the draft, Article 171 stipulates to expand the quota for receiving transfer of agricultural land use rights of households and individuals to no more than 15 times the agricultural land allocation limit and assign responsibility to the Provincial People’s Committee. stipulate the limit for receiving the transfer of agricultural land use right of an individual in accordance with the specific conditions of the locality.
