Reforming the Right to Conscientious Objection in Healthcare: Chamber of Deputies Approves New Regulations

The Chamber of Deputies approved reforms on Tuesday to regulate and limit the right to conscientious objection of the medical and nursing staff of the country’s health institutions.

The opinion, by which various provisions of the General law of health, was approved with 304 votes in favor, 114 against and 13 abstentions; and took turns Senate.

Conscientious objection is the individual right that medical personnel assigned to the National Health System have to refuse to perform a medical procedureconsidering it contrary to their religion, moral principles or ethics.

The reforms establish that the Health Secretary must guarantee that its units have non-conscientious objector personnel to ensure care for all patients and not compromise their health or life.

Personnel who want to exercise their right to conscientious objection in a health procedure must inform the institution.

However, conscientious objection cannot be invoked when it is in risk life of the patient or it is a medical emergency.

Nor will it be appropriate when there is insufficient non-objecting medical personnelwhen the refusal or postponement of the medical attention implies a risk to the patient’s health or there is the possibility of leaving consequences or disabilities.

The president of the Health Commission, Emmanuel Reyes Carmona, assured that the opinion resolves what was mandated by the Supreme Court of Justice of the Nation (SCJN), which since 2021 ordered Congress to regulate conscientious objection.
