After eight months of taking of the central headquarters located in Providencia, this Monday the director of the National Institute of Human Rights (INDH), Sergio Miccoasked the presidential delegation of the Metropolitan Region -headed by Constanza Martínez (CS)- to be carried out eviction of the building, butrespecting international human rights standards”.
The agency’s facilities have been taken over since July 8, 2021 by the Secondary Student Coordination Assembly (ACES) and members of other organizations. And despite the creation of a commission of advisers to dialogue with the occupants, the conflict continues.
In this framework, and after failed negotiations, on February 25 the Comptroller General of the Republic issued an ultimatum by opinionin which it established that the INDH authorities must adopt measures to recover the use of the headquarters within a period of 30 days.
So, and after the comptroller Jorge Bermudez pronounced, the director of the agency – who communicated in the last few hours with the undersecretary of the Interior, Manuel Monsalve – had to make the request to the regional presidential delegation, since if the ruling of the supervisory body is not executed within the corresponding period, according to him article 12 from Law 20,405would mean a breach and would submit to the INDH yet administrative summary and a possible judgment of accounts.
The eviction, from now on, could take place at any time, including the following hours. And the delegation must specify it before April 5, which is the date on which the deadline given by the Comptroller’s Office expires.
In this regard, from the Metropolitan Regional Presidential Delegation of Santiago they only asserted that “it is collecting necessary information on the request made by the INDH.”
After the request submitted to the delegation on March 14, Micco indicated that “from the first day of the occupation we opted for the path of dialogue to unblock this situation. However, the innumerable efforts did not have a positive response from the occupants”.
In this context, he made alast call to vacate the property voluntarily and re-establish dialogue” and requested “the collaboration of those political and social forces that supported the occupation for the justice of their demands, to intercede for the voluntary vacating of the headquarters.”
In addition, he specified that despite not being able to use the dependencies, “the institution has made an effort to continue fulfilling its tasks, and with the legal mandate of protection and promotion of human rights. However, we need to return home and resume work as normal.”
“The INDH is an institution that belongs to all Chilean men and women,” he added.
