SBT, RedeTV and Record still want to charge for presence on pay TV

The company Simba Content, created by SBT, RedeTV and Record for the joint marketing of audiovisual content, is still in dispute with small pay TV distributors for charging linear channels in pay-TV packages.

Currently, the channels of the three broadcasters are given to the distributors free of charge by order of the Administrative Council for Economic Defense (Cade), which approved the creation of Simba Content in 2016 for six years to deal with the subject.


This year, Simba Content requested an extension of its authorization and Cade’s General Superintendence accepted the request, but was the target of an appeal by Associação Neo, which represents small pay TV distributors in the dispute.

Associação Neo claims that renewing Simba without any conditions will be harmful to small Pay TV distributors. Cade’s collegiate will judge the case if the entity’s appeal is accepted. There is no scheduled date for this.

In turn, Simba countered Neo’s arguments in a document sent to Cade. The company says it does not hold market power and that its creation did not change the percentages of concentration in the TV channel licensing segment.

Simba also stated that the sector has changed and it is necessary to classify streaming platforms among competitors. The company also highlighted that it does not intend to practice “supra-competitive” prices in the licensing of open channels for inclusion in pay TV.


“In the current context, in which broadcasters compete for audience and revenue with new platforms and need resources to invest in content and technology, Simba would have incentives to negotiate a reasonable price with OPPs to earn some revenue from licensing its channels. partners. In short, any price greater than zero would be attractive to Simba,” he writes in the statement.

Still in its argument, Simba cites a study by Kantar Ibope Media, which pointed out that 68% of investment in 2022 went to online video platforms (Youtube, Netflix, Globoplay etc). So broadcasters need new ways to earn revenue.

please note that Record, Rede TV and SBT even announced the end of the transmission of their signals on pay-TV in 2017 because of this same dispute, which has existed for some years between the three broadcasters and pay-TV distributors.
