Filed in the U.S. District Court for the Southern District of New York on August 20, 2026, the legal action seeks Digital Millennium Copyright Act (DMCA) disclosures more than three months ahead of the game’s scheduled November launch.
The Legal Mechanics Behind the Take-Two Subpoenas
The court filings state that the leaked material contained copyrighted assets, including audiovisual content, artwork, images, dialog, and other creative elements. Take-Two is utilizing the DMCA to compel Microsoft and Discord to surrender user data that can identify the alleged infringers. According to the court documents, the leaked assets were distributed across Microsoft’s GitHub developer platform and various Discord servers using multiple user accounts.
Discord maintains a standard procedure for handling these legal demands. A Discord spokesperson told Variety that the platform occasionally receives DMCA subpoenas and routinely analyzes and complies with valid requests.
Meanwhile, representatives from Microsoft have not responded regarding the subpoena. Rockstar has yet to publicly confirm the authenticity of the leaked material.
