Defense Demand Rejected as Judge Refuses to Remove Holdout Juror
Defense attorney Kevin Reddington clashed openly with Judge William Sullivan in the Plymouth courtroom after learning that a single juror was holding up a verdict by allegedly refusing to accept instructions on reasonable doubt. Reddington told reporters that the note indicated one member refuses to listen to the law concerning the evidentiary threshold, leading him to demand the juror’s dismissal.
Judge Sullivan declined the defense request. Instead, the judge brought each juror into the courtroom individually, questioned them in private, and then provided a thorough re-instruction on what constitutes proof beyond a reasonable doubt. Judge William Sullivan, after receiving the jury’s note, brought in each juror individually and questioned them in private. The judge then reread his instructions on reasonable doubt before sending them back to continue deliberating on a verdict.
That prompted an angry objection from Clancy’s lawyer, Kevin Reddington, who demanded that one juror be removed.

The discord inside the jury room follows a broader pattern of deadlock reported earlier in the week. Clancy, a 36-year-old former labor and delivery nurse, doesn’t deny strangling her children in the basement of their home in 2023 before trying to take her own life. Her attorney argues that postpartum psychosis led to her actions, while prosecutors say she knew what she was doing when she killed Cora, Dawson, and Callan Clancy, ages 5, 3, and 8 months.
Clancy’s livestreamed trial has generated intense interest, with reporters and spectators packing the courtroom. The case has also sparked deep public divisions over her culpability and the issues around maternal mental health after childbirth.
Clancy faces life in prison without parole if convicted of first-degree murder. If found not guilty by reason of lack of criminal responsibility, or reason of insanity, she could be committed to a state psychiatric hospital.

The issue with the juror is expected to be addressed again when court convenes at 09:00 EST (14:00 BST) on Friday. If the jury does not reach a verdict and Judge Sullivan declares a mistrial, prosecutors would need to decide whether to retry the case.
The jury will return Friday to see if they can reach a decision on whether the Massachusetts mother is criminally responsible for killing her three children.
