It was on September 6, through a press release, that the Ministry of Justice announced that Minister Marcela Ríos had appointed Carlos Miranda Jiménez as the new Conservator of Mortgages and Encumbrances of Santiago, putting an end to one of the most coveted contests within the Judiciary.
In the text sent by the Executive to the media, it was emphasized that of the “short list proposed by the Court of Appeals of Santiago, Carlos Miranda Jiménez was the one who obtained the highest score during the application process without registering, in addition, disciplinary measures. against him”.
From then on, a series of accusations began to circulate in lawyer chats and even in the political sphere, where feminist organizations did not welcome the arrival of the penquista notary. Without going any further, from the Maule region a group of groups sent a letter to President Gabriel Boric in which they expressed their “deep concern over the appointment of Mr. Carlos Miranda as Custodian of Mortgages and Encumbrances.”
“We request through this letter and in view of the public news about the actions of Mr. Carlos Miranda, proceed to rectify and respect the large majority that he obtained in his qualifications and vote of the Court of Appeals of the first woman in the more than 200 years of history of the Custodian of Mortgages and Encumbrances of Santiago, Camila Jorquiera”, the document pointed out in one of its passages.
Immediately afterwards, these questions were dismissed by Miranda himself, who in dialogue with the newspaper La Tercera stated that the facts “are false questions, it is an artificial controversy since it is recorded in the labor courts that these collaborators were not ex officio dismissed when they were pregnant, in any case, I have no cause in court for these matters.
After a month, The Comptroller General of the Republic gave the green light to the appointment decree. It should be remembered that the purpose of this procedure is for the supervisory body to review that the candidate complies with the law and with the administrative background necessary for the position.
With the above, Miranda could already assume the position of Custodian of Mortgages and Encumbrances of the Custodian of Real Estate of Santiago. The one that has been led since September 2021 by the substitute -appointed by the Court of Appeals-, the notary Francisco Leiva.
