After 20 years of starting a cause of great public importance, with firm favorable sentences in favor of the citizen claim for free access to Lago Escondido, today the Superior Court of Justice, resolved the annulment of the rulings that enabled access by the only safe public road that does not imply harm to the environment.
It is to remember Article 73 of the Provincial Constitution establishes that the State of Rio Negro must guarantee access to all water bodies located in the territory of the Province of Río Negro, which are in the public domain.
Lago Escondido is one of those public goods. A natural wonder that was enclosed in the domain of the ranch that the billionaire Joseph Lewis bought in 1996, who built his ostentatious mansion on the road itself. In parallel, the bridges built by the public treasury were dynamited so that no Argentine intruder could reach the Lake, which became a kind of private pool for the English businessman.
As a way of simulating compliance with the Constitution, the Río Negro government and Joseph Lewis signed a private right-of-way agreement in 2002 for an inaccessible mountain path, precisely so that no one could pass through… and they achieved it with the ruling handed down in the day of the date that validates it as “the only access to the water mirror, exclusive for an elite”.
This Superior Court of Justice, which allowed itself to ignore final judgments with the authority of formal and material res judicata, is:
•The same Court that allows the action of parapolice groups at the service of the English businessman who attempted against the lives of hundreds of citizens who demand free access to Lago Escondido, year after year.
• It is the same Court with judges with proven political ties to the Provincial Government that they refused to step aside when they were suspected of partiality and lack of independence from the Political Power and that today they signed this sentence without flinching;
• It is the same court that allows Lago Escondido to be “outside” the tourist corridor of the province in order to guarantee exclusivity. businessman Lewis, and his friends judges, businessmen and officials to hold their “hidden” meetings.
• That same court that with this sentence, violates the National Constitution and current accessibility laws by “sacrificing” children, the elderly and people with disabilities. from all of Argentina who will never be able to see Lago Escondido by being forced to travel a highly dangerous mountainous path on horseback or walking for 4 days.
• And it is the same that – in fact – violates Argentine sovereignty by handing over part of the territory -located in the border area- to the British capital.
This new act of impunity for the English businessman by the Government of Arabela Carreras, Alberto Weretilneck and the highest judicial body, contrasts with the treatment of the US Justice, which is about to imprison Joseph Lewis for serious crimes.
We will go before the Supreme Court of Justice to reverse this “anti-rights” ruling and we will do the same before the Inter-American Commission on Human Rights. But we will not stop denouncing the criminal and political responsibility of those involved. We will initiate a political trial against the Judges and Judges, in addition to Attorney General Crespo for the crime of treason against the Homeland when executing an act aimed at totally or partially submitting the Nation to foreign rule or undermining its independence and integrity (art. 215 CP).
