Unconstitutional speech: Saji Cherian should not resign as MLA; The High Court dismissed the petition High court order in favor of saji cherian

Kochi: The High Court rejected the plea to disqualify MLA Saji Cherian for his anti-constitutional speech. A division bench presided over by the Chief Justice passed judgment on the petition. The petitioners are Biju P, a native of Malappuram, and BSP state president Vayalar Rajeevan.

The demand is that the problem does not end with resignation and there is a need to intervene to disqualify the MLA who insulted the constitution. But the High Court had observed that there was no legal provision to disqualify Saji Cherian.

The police move to close the investigation against Saji Cherian for his unconstitutional speech. The investigation is concluded by pointing out that there is no evidence that Saji Cherian violated the Constitution. The Thiruvalla court directed the Kirvaipur police to file a case following a petition filed by a lawyer from Kochi, Baiju Noyal. During the six-month investigation, the police did not record Saji Cherian’s statement.
