CD&V Chairman Sammy Mahdi believes that the fact that the Council of State can provide a “legal clarification” on the Open VLD and N-VA’s proposed nitrogen decree is a good thing. But the majority of the Flemish government will then have to take this opinion into account if it is negative. “If two parties of the majority ignore the words of the Council of State, stubbornly stick to the current proposal and then seek a parliamentary majority distinct from the existing majority, the government will find itself in a new reality”, he expressed on Twitter.

The party president therefore warns his coalition partners, N-VA and Open VLD, not to seek a new majority in the event that the opinion of the Council of State is negative.

The N-VA and the Open VLD tabled a proposal for a decree on nitrogen emission standards in the Flemish parliament on Thursday, without the coalition partner, the CD&V. They ask the President of Parliament to seek the opinion of the Council of State. The nitrogen file is therefore moving, largely under the pressure of the Ineos judgment and an impending “vacuum” in licensing, from the table of the Flemish government to parliament. The CD&V will not co-sign the decree proposal, because the party has made its support for the agreement on the environmental impact study conditional on its two demands relating to external compensation and the adaptation of emission thresholds .

Sammy Mahdi made it known in a series of tweets that he was also pleased that Flemish Environment Minister Zuhal Demir’s “terrible instructions” had been withdrawn. The council of the Council of State can, according to him, provide “legal clarifications”.
