Cyber evidence and testimony were crucial in the Kollam Vismaya case. The phones, including that of her husband Kiran Kumar, were subjected to a cyber check as part of the case investigation. This test found multiple conversations over the phone. It also included conversations between Kiran and his wife about the dowry. All this was presented to the court as prosecution evidence. Kiran was charged with dowry harassment, incitement to suicide, injury, intimidation and solicitation of dowry.
The prosecution cross-examined 41 witnesses. 118 documents were numbered and 12 bounties were produced. Five witnesses, Kiran’s father Sadasivan Pillai, nephew Anil Kumar, wife Bindukumari, Kiran’s sister Keerthi and husband Mukesh M Nair, testified during the interrogation.

Those who testified in court as prosecution witnesses made strong statements against Kiran. The first witness, Vismaya’s father Trivikraman Nair, mother Sajitha and sister – in – law Revathi testified against the accused in court.
He agreed to pay 101 pawans and a car and constantly tortured Vismaya …
Vismaya’s father Trivikraman Nair had told the court that her husband Kiran was constantly harassing her because she did not like the dowry car and the gold was missing. At the time of the marriage, he agreed to give 101 pawans of gold, 1.2 acres of land and a car. Due to Kovid situation, he was able to pay only Rs 80 crore. Kiran, who came home for the wedding, did not like the car he bought. He told his daughter that he could buy another car on his wedding day. It was only when she weighed the gold to put in the locker that Kiran realized that there was less. The car was also found to have a bank loan. In the name of this, amazement pervaded.
Later, during the journey, Vismaya was beaten at Chittumala. After attending Kiran’s sister’s son’s birthday party, he allegedly took his daughter home in a car and harassed her over dowry. Meanwhile, his son Vijith was also injured in the incident. When Kiran returned from treatment at the hospital, her father, a relative and two motor vehicle department officials were at home. On January 11, when he went to invite his son Vijith to his wedding, Vismaya realized that he was in trouble again and called him home. Kiran and her relatives did not attend her son’s wedding.
After the marriage, the daughter told her daughter-in-law all the details. He was in touch with a community organization to end the marriage. Kiran, who arrived on March 25 to take part in the discussion, took her daughter away on March 17 to avoid a case. He further added that Kiran had blocked his and his son’s phone numbers and Facebook.
On June 21, Kiran’s father called Vismaya to the hospital. Trivikraman Nair had said that he came to know about the death on the way to the hospital. The witness also identified in court that the conversation between Kiran and Trivikraman Nair was obtained from Kiran’s phone.

Vismaya’s mother Sajitha V Nair had also revealed in court that Kiran’s father had said that all the problems would be solved if the dowry was promised.
It was okay for a while after the wedding. The harassment started when he went to put the gold in the locker saying that it was not in the stated quantity. The daughter told the full story of the abuse when she was called home in connection with Vismaya’s brother’s wedding. The community organization was then informed. Her mother said she was told to adapt to the circumstances in the hope that the dowry would solve the problems.
Witness Sajitha identified the recorded conversations on her own phone and the voices of Kiran and her relatives in court. There was also a conversation in which Vismaya cried that she was being tortured in the name of dowry. Kiran’s sister was also heard telling Keerthi that she will not talk about dowry on the phone and will only talk on WhatsApp as it will be on record. The witness, who overheard Kiran talking to her brother – in – law Mukesh, said that if the allegation of dowry came up, the story that Vismaya had other relationships could be suppressed. Asked if he had told Vismaya’s father that he would go back with Vismaya Kiran, the mother had told the court that it was her fault.

Vismaya’s brother Vijith’s wife, Dr. Revathi had also made it clear in court. They said that Vismaya said that Kiran would hold her close to the wall and stab her in the neck and then step on the ground and kick her face in the face. Ever since Vijith’s marriage proposal came, he has been talking to Vismaya. Vismaya was a happy and vibrant child. A month after the marriage, Vismaya became sad. He had spoken physically and mentally about the dowry and sent a message on WhatsApp.
Vismaya got down on the road when he got into a fight on the road during Onam saying he did not like the car. Vismaya also asked, “Am I a waste, sis?” Kiran did not attend Vijith’s wedding. He later revealed all the troubles he had experienced in awe. Kiran would have said that she got married thinking she was the daughter of a Gulf man and the sister of a merchant sailor. However, Kiran said that she got a tenant and a waste woman.
She informed her husband Vijith and her parents that a child studying for an Ayurveda course could not bear to lose his identity and do so. On March 17, Vismaya was taken away from Kiran College, where she was to be discussed following a complaint lodged at a hand meeting. After that, Vismaya cut ties with him. Kiran blocked the phone. Revathi identified her phone and Vismaya’s messages in court. According to Special Public Prosecutor G Mohanraj, the screenshots of the messages were given to the media on the day of Vismaya’s death.

The doctor who confirmed Vismaya’s death said that Kiran said that Vismaya died as a result of a quarrel. Amal Yashodharan said. When the death was confirmed and he came out and inquired about the matter, the man who introduced himself as her husband said that they had a quarrel and then went into the bathroom in amazement and slammed the door. After a while, he said that he was pushed open because he could not hear the sound and went inside.
Ajesh, a motor vehicle department official who was Kiran’s colleague, testified that he went to the Chadayamangalam police station knowing that Kiran had been detained. He also went to Vismaya’s house and talked about the problem affecting his work. The witness stated that the problem was related to the car and then the problem was solved at the station.
Prabhakaran Pillai, Grama Panchayat Secretary, Nilamel, who registered the marriage of Vismaya and Kiran, and Rajesh, Federal Bank Branch Manager, Nilamel. Fatima, N.S. Hospital Deputy Medical Superintendent Dr. Sreekumar and Kunnathoor tehsildar Nizam, who conducted the inquest, were also called as witnesses in the case.
Kiran’s grandfather’s son Anil Kumar, a security guard, and his wife Bindukumari, a health department employee, had changed their statements in court. With this, the witnesses were declared dissenters. Bindukumari was pronounced dead at the hospital by Special Prosecutor G Mohanraj.
Kiran’s father Sadasivan Pillai had objected that he did not tell anyone about the paper he had handed over to the police. Sadasivan Pillai said that Kiran had a quarrel with Vismaya over the lack of gold.
Kiran’s sister Keerthi said that there was no dispute between Kiran and Vismaya regarding the dowry. Following this, Keerthi was also declared to have defected.
