Although his execution was carried out in March 2020, the Official Gazette published the decision of the 10th Criminal Court, south of Cairo, to include the terrorist Hisham Ashmawi and 45 others on the list of terrorists for a period of 5 years.

The decision came in Case No. 21947 of 2014 Nasr City First Criminal Case, known as the “Ansar Beit al-Maqdis Organization” case, which included Omar Rifai Sorour and the murdered terrorist, Tawfiq Freij, the founder of the Beit al-Maqdis organization.

The Military Appeals Court upheld two death sentences for “Ashmawi” for his conviction in the “Farafra” and “Ansar Bayt Al-Maqdis III” cases.

What is the legal consequence of the listing decision?

Law No. 8 of 2015 Regulating Lists of Terrorist Entities and Terrorists, as amended by Law No. 14 of 2020, specifies the implications of the decision to be included in the list of terrorists as follows:

1- Inclusion on travel ban lists, anticipation of arrival, or banning a foreigner from entering the country.

2- Withdrawing or canceling the passport and losing the condition of good reputation for taking up jobs.

3- Refrain from appointing or contracting with public posts or business sector companies

4- Suspension from work with payment of half the wage

5- Freezing the funds owned by the terrorist, whether wholly or in the form of a share in joint ownership, the proceeds generated from them or controlled directly or indirectly, and the funds and other assets of the persons and entities operating through him.

6- Prohibition of financing or collecting funds or things for terrorists, whether directly or indirectly, and prohibition of receiving or transferring funds, as well as other similar financial services.

In the case of the listed defendants, including “Ashmawy”, the implications of their inclusion will allow “freezing the funds and assets” owned by him and transferring them after completing the legal procedures to the public treasury.

Article 1 of the law clarifies the meaning of “freezing funds” as all financial assets and economic resources, including oil and other natural resources, and property of any kind, whether material or intangible, movable or immovable, regardless of the means of obtaining them, legal documents and tools, national or foreign currencies, and papers. Financial or commercial instruments and papers evidencing all of the aforementioned in whatever form, including digital or electronic form, and all rights related to any of them, including bank credit, travelers checks, bank checks, documentary credits, and any interest, profits, or other sources of income accruing from these funds. assets, or assets generated therefrom, or any other assets that have been used or are likely to be used to obtain financing, products, or services.
