The Independent Commission Against Corruption has been issued a warrant by a magistrate for the arrest of Yang Linlong (58), a former adjunct associate professor of the Department of Chemistry of the Hong Kong University of Science and Technology. Procurement activities involving a total of about 4 million yuan.

The case occurred between September 2011 and February 2019. At that time, Yang Linlong was responsible for 17 tendering and procurement activities, purchasing a number of laboratory instruments and testing services for HKUST and its subsidiaries from Junke and Micro Motion, which he had direct or indirect financial interests in. According to HKUST regulations, Yang Linlong, who is also an adjunct associate professor, is required to declare his conflict of interest with the supplier before engaging any supplier. In addition, suppliers are also required to declare whether they have any interest in HKUST staff.

Yeung faces a total of 17 counts, namely three counts of conspiracy to defraud, contrary to common law; and 14 counts of fraud, contrary to section 16A of the Theft Ordinance. Junke (Asia) Pharmaceutical Co., Ltd. (Junke) sole proprietor and shareholder Ouyang Zhaoyu (42) and Micro Motion Inspection and Testing Co., Ltd. (Micro Motion) sole proprietor and shareholder Yang Zhaoan (40) were also charged at the end of September. the above charges. Yang Zhaoan became the sole director and shareholder of Micro Motion at the end of 2011. Junke was established in mid-2012, and Yang Zhaoan was its sole proprietor and shareholder at that time, and Ouyang Zhaoyu replaced Yang Zhaoan as the relevant position at the end of the same year.

The conspiracy charge alleges that Yang Linlong is suspected of conspiring with Ouyang Zhaoyu or Yang Zhaoan to defraud HKUST, concealing his interests in Junke and Micro Motion while Yang Linlong is obliged to disclose any conflict of interest with HKUST in advance, and induce HKUST to Three of the above-mentioned tendering and procurement activities engaged Junke and Micro Motion, and resulted in the full payment of the invoices by the two suppliers.

The remaining charges allege that Yang Linlong, together with Ouyang Zhaoyu or Yang Zhaoan, allegedly concealed Yang Linlong’s interests in Junke or Micro Motion, inducing HKUST or its affiliates to engage the two suppliers in 14 other tendering and procurement activities. The 17 bidding and procurement activities involved a total of about 4 million yuan.

After receiving a corruption complaint earlier, the ICAC launched an investigation. After completing the investigation, it sought legal advice from the Department of Justice. After obtaining legal advice, the three were prosecuted. Because Yang Linlong has left Hong Kong, the ICAC applied to the Magistrates Court last Friday (October 7) for a warrant to arrest him and was issued a warrant by the magistrate. The cases of Ouyang Zhaoyi and Yang Zhaoan were adjourned to October 27 for further hearing. HKUST provides comprehensive assistance during the ICAC investigation.
