25th Amendment Calls for President Biden’s Mental Health and Potential Constitutional Action

In a Tuesday letter to Harris, Morrissey cites Special Counsel Robert Hoare’s report last week, detailing numerous memory lapses by Biden, and other repeated missteps he made during his time in office as reasons for taking such drastic constitutional action.

“For too long, Americans have had to stand by and watch their president suffer profound cognitive decline,” Morrissey said. “These serious mental errors have serious consequences.”

“I am writing to urge you to exercise your powers under Section 4 of the 25th Amendment and declare that President Biden is unable to discharge the powers and duties of his office,” Morrisey added.

Other elected officials also called for invoking the 25th Amendment after the release of the Hoar report, including Senator Josh Hawley, Republican of Missouri, and Representative Claudia Tenney, Republican of New York.

The controversy is renewed with the increasing slips of US President Joe Biden’s tongue during the recent period and talk about the instability of his mental health, which angered Biden and prompted him to confirm that he does not suffer from memory problems.

Biden will be 86 years old at the end of his potential second term. The president said it was fair for voters to take his age into account, but he and his team emphasized that he should be judged on his record of accomplishments while in office.

His potential opponent, former President Trump, is 77 years old and in recent weeks has faced increasing scrutiny for his mistakes.

Twenty-fifth Amendment to the United States Constitution

  • The first section explains that the Vice President becomes President if the President dies, resigns, or is removed from office.
  • Section II sets forth the procedures for filling any vacancy in the Office of the Vice President.
  • Section III allows the president to temporarily transfer his or her duties to the vice president, for example during a planned medical procedure.
  • Section IV provides that the Vice President, with a majority of certain Cabinet officers, may declare the President incapable of performing his duties, after which the Vice President shall immediately assume the duties of President; If the President objects to such a declaration, Congress shall resolve the matter.
