The Evolution of Surveillance Law
Historically, U.S. Surveillance law has evolved in response to technological advancements. The Fourth Amendment, ratified in 1791, protected against unreasonable searches and seizures, initially focused on physical intrusion. Later, the Federal Wiretap Act of 1968 addressed the interception of telephone conversations, and the Electronic Communications Privacy Act (ECPA) of 1986 expanded protections to include computer and electronic communications. Still, these laws largely predate the widespread availability of the internet and the massive data trails individuals now generate.
The Foreign Intelligence Surveillance Act (FISA) of 1978 further regulates government surveillance, particularly in cases involving national security. Loren Voss, a former military intelligence officer at the Pentagon, emphasizes that such collection is intended to be targeted. OpenAI’s Contract and the Limits of Corporate Control
Recognizing these concerns, OpenAI has amended its contract to prohibit the intentional use of its AI systems for domestic surveillance of U.S. Persons and nationals, aligning with relevant laws. This amendment specifically prohibits “deliberate tracking, surveillance or monitoring of U.S. Persons or nationals, including through the procurement or use of commercially acquired personal or identifiable information.” However, this restriction is tempered by a clause allowing the Pentagon to use the AI system for all lawful purposes.
Jessica Tillipman, a law professor at the George Washington University Law School, points out the limitations of such contractual agreements. “OpenAI can say whatever it wants in its agreement … but the Pentagon’s gonna use the tech for what it perceives to be lawful,” she explains. This suggests that, the Pentagon’s interpretation of “lawful purposes” will likely determine how the technology is deployed, and companies may have limited ability to prevent its use for domestic surveillance.
