This 31-year-old homeless man is barely recovering from injuries to his left hand, leg and crotch which earned him fifteen days of ITT: scars from punches, two stab wounds and bites of an attack dog launched in his direction.
The situation escalates
The versions diverge between the protagonists. But everyone agrees to say that the story began the day before, in an apartment in Lormont. The two defendants, a 47-year-old man and a 23-year-old young woman, who have been together for a month, are spending the evening with a family member. The victim joins them. Tempers flare.
The next day, around 1:20 p.m. in the Capucins district of Bordeaux, the trio came face to face, some reproaching each other for the inappropriate behavior of the day before. A fight breaks out. The young woman admits in court having beaten the homeless man to defend her companion. But in the excitement of the situation, the couple who was accompanied by a categorized dog, no longer controls the animal, which, stripped of its muzzle, attacks the victim.
For the prosecutor, Marc Ottomani, the story leaves no room for doubt: “The facts are extremely serious, so much so that they were first qualified as attempted homicide before being requalified as aggravated violence. The public prosecutor requires four years in prison with continued detention and six-month suspended revocation, as well as a ban on keeping an animal for ten years and a weapon for five years against the 47-year-old defendant. One year firm, with the prohibition to hold an animal and a weapon for five years and confiscation of the dog given to the SPA of Mérignac are required against his companion.
Finally, the court sentenced the 47-year-old defendant to three years in prison with continued detention, and his companion to two years in prison without a warrant. They are both prohibited from possessing a weapon and a dog subject to authorization for five years and have ten days to appeal. A medical expertise on the victim was ordered for the damage, with a provision of 6,000 euros.
