Asonal opposes Gustavo Bolívar’s project that modifies Legal Medicine – Research – Justice

Through a statement from the judicial system unions (Asonal) expressed his disagreement with the Bill No. 185-22according to them, proposed by Senator Gustavo Bolivar.

The initiative would change the nature of the National Institute of Legal Medicine to create an autonomous institution that was not part of the prosecution.

Asonal He requested to read and analyze “the project carefully” so that they could make the respective clarifications in the face of the questions that would be generated in the event that the bill was approved.

In the eleven points listed, Asonal raised questions such as:

  • “If the National Institute of Legal Medicine and Forensic Sciences was created constitutionally and through a legislative act. Is it possible that a law can change a legislative act?
  • Why is this new institution given, if it were created, the same functions as the National Institute of Forensic Medicine?
  • Knowing that according to Decree Law 938 of 2004 art. 33 the Institute of Forensic Medicine has administrative autonomy and legal status, why change to a new institution?

In addition, they state that the proposal presented “was never disclosed to all the public servants that are part of the Institute so that it could be analyzed and, if necessary, suggest alternatives for improvement”.

Also, there is talk about the uncertain future of the officials of the institution since
“maximum 97.22% of public servants are in Provisional status without administrative career regime”.

This means that they are under a transitory and temporary hiring modality that allows those who were not selected through the merit system to have an administrative career job.

With the new institution, this contracting modality would change towards one with the administrative career system, for which the unions wonder if all employees must now present a merit test to access it.

Implying that the officials who belong to the Institute are ‘corrupt’

In a section of the statement, a strong warning is made to Senator Bolívar in which they state that, in a statement made by him, he says that “The National Institute of Legal Medicine is an appendix of the Attorney General’s Office, so there is no guarantee of transparency, there is no reliability of the judicial system”.

This is what the unions take as an indication and malicious judgments regarding the credibility it has as an institution.

Due to the above, for Asonal it is of great concern that this type of project has been filed in Congress without having the endorsement of the four union organizations that there is in the institution, and without there being a clear document socialized with the Ministry of Justice, the Prosecutor’s Office, the National Police or the Administrative Department of the Civil Service.
