The Community of Madrid, chaired by Isabel Díaz Ayuso, has decided this Wednesday to file an appeal against the central government before the Constitutional Court, considering that its powers have been invaded with the bidding for a state contract for the creation of a stable collection service. , awareness, loyalty and training of families interested in fostering supervised minors. The decision only deepens the permanent clash between the two Administrations in its judicial aspect. Thus, since Ayuso came to power in August 2019, the Community has appealed fifteen state decisions in court. Although the court has ruled in favor of Madrid on issues such as the VAT of December 2017, which brought an extra 300 million to the regional coffers, it has also rejected its claims regarding key issues such as the Baccalaureate curriculum or the tax on great fortunes, which the Constitutional Court endorsed.

“We are convinced that we are completely right,” said Díaz Ayuso at a press conference at the Alcalá de Henares City Council, where he has chaired the Government Council in an extraordinary manner, and has referred explanations on this matter to the government spokesperson. , Miguel Ángel García. This is what the presidential advisor also explained about an initiative that comes from Ana Dávila, head of the Family, Youth and Social Affairs portfolio.

“This decision comes after the central government has not responded to a request sent by the regional government in December for the cancellation of this contract,” García said about an initiative that the regional Executive had been studying since December 2023. “The Lawyers remember that the powers that the central government assumes are not a matter of state management, since the guardianship of minors corresponds to the autonomous communities,” he argued.

“I want to remember that we are working intensely on this service to support foster families, and that we have just increased the monthly aid they receive per child by 30%,” he added. And he concluded: “What we ask of the central government is that it takes care of the powers that it does have assigned, such as Cercanías, and that it does not double the expenditure and invade the powers that the communities do have.”

As the regional government already advanced in December the possibility of going to the High Court on this issue, the matter has not found the central Administration offside, which has defended the contract as a way of providing more resources for the reception of minors. .

“The powers are autonomous,” acknowledged a spokesperson for the Ministry of Children and Youth, headed by Sira Rego. “The Government is offering resources so that more families can access the reception services managed by the Autonomous Communities,” she continued. “[El contrato] reinforces with resources to prevent boys and girls under six years of age from being in centers.
